Terms of Use
1. Introduction and Acknowledgement
These Terms of Use ("Terms") constitute a legal agreement between you ("you" or "user") and Alina Dauhaliova ("we," "us," "our," or "the Developer"), based in Portugal, European Union, for the use of the SayMore mobile application ("the App").
By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
Age Requirement: You must be at least 13 years of age to use the App. By using the App, you represent and warrant that you meet this age requirement. If you are under 18, you confirm that you have obtained the consent of a parent or legal guardian to use the App and agree to these Terms.
Important: This agreement is between you and the Developer only, and not with Apple Inc. ("Apple"). The Developer, not Apple, is solely responsible for the App and its content.
2. Scope of License
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App on any Apple-branded device that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.
You may not:
- Distribute or make the App available over a network where it could be used by multiple devices at the same time
- Sublicense, rent, lend, sell, or redistribute the App
- Copy, decompile, reverse-engineer, disassemble, or attempt to derive the source code of the App
- Modify, adapt, or create derivative works based on the App
3. Purchases and Subscription Terms
3.1 Free Content
The App provides a selection of questions and categories at no charge. No purchase or subscription is required to access this free content.
3.2 Subscription Plans
SayMore offers auto-renewable subscription plans ("SayMore Pro") that unlock premium content and features, including all question categories and Date Night Mode. New content may be added from time to time as part of the subscription at no additional cost.
Current subscription options and pricing are displayed on the subscription screen within the App. Prices may vary by region and are subject to change.
3.3 Lifetime Purchase
SayMore also offers a one-time, non-recurring "Lifetime" purchase that grants access to all premium content and features available at the time of purchase, for as long as the App remains available and compatible with your device. This is a non-consumable in-app purchase and does not auto-renew. The cancellation, renewal, and free trial provisions below do not apply to the Lifetime purchase.
The Lifetime purchase includes access to content updates and improvements to existing features. However, substantially new features or content categories that involve additional ongoing costs to the Developer may be offered separately or as part of a different purchase tier. We will clearly communicate any such changes within the App.
3.4 Billing and Payment
- All payments are processed by Apple through the App Store. We do not collect or store your payment information.
- Subscription fees are charged to your Apple ID account at confirmation of purchase.
- Your subscription will automatically renew at the end of each billing period unless you cancel at least 24 hours before the end of the current period.
- Your account will be charged for renewal within 24 hours prior to the end of the current billing period at the rate of the selected plan.
3.5 Free Trials
If a free trial is offered, it will be clearly stated on the subscription screen along with its duration. When the free trial expires, your paid subscription will begin automatically, and your Apple ID account will be charged unless you cancel at least 24 hours before the trial ends. Any unused portion of a free trial is forfeited when you purchase a subscription.
3.6 Cancellation
You may cancel your subscription at any time through your Apple ID account settings (Settings > [your name] > Subscriptions). Cancellation takes effect at the end of the current billing period. You will retain access to premium features until the end of the period you have already paid for. No partial refunds are provided for unused portions of a billing period.
3.7 Refunds
Refund requests must be directed to Apple in accordance with Apple's refund policies. We do not process refunds directly. You can request a refund at reportaproblem.apple.com.
4. Content and Intellectual Property
All content in the App — including but not limited to questions, text, graphics, icons, images, and the overall design — is the intellectual property of the Developer and is protected by applicable copyright and intellectual property laws.
You are granted a limited license to use this content solely within the App for personal, non-commercial purposes. You may not:
- Reproduce, distribute, or publicly display the App's content outside of the App
- Use the App's content for commercial purposes, including in competing products
- Claim authorship or ownership of any content provided by the App
- Systematically extract, scrape, harvest, or collect the App's content through any automated or manual means
- Use the App's content to train, fine-tune, or otherwise develop any machine learning or artificial intelligence model or dataset
5. Acceptable Use
You agree to use the App only for its intended purpose as a couples conversation and connection tool. You agree not to:
- Use the App for any unlawful purpose
- Attempt to gain unauthorized access to any portion of the App or its systems
- Use the App in any way that could damage, disable, or impair the App's functionality
- Use automated scripts or bots to access or interact with the App
6. Entertainment Disclaimer
SayMore is designed for entertainment and personal connection purposes only. The App does not provide and is not intended to be used as a substitute for professional relationship counseling, therapy, psychological advice, or any form of medical or mental health treatment.
If you are experiencing relationship difficulties or mental health concerns, please seek guidance from a qualified professional.
7. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the App will be uninterrupted, error-free, or free of harmful components. The App is a conversation tool for entertainment and connection purposes and is not a substitute for professional relationship counseling or therapy.
If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the App (if any) to you. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the App.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE DEVELOPER BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OR INABILITY TO USE THE APP.
Our total cumulative liability to you for any and all claims relating to the App shall not exceed the amount you paid for the App or subscription in the twelve (12) months preceding the claim. If you have not made any payments, our total liability shall not exceed zero (€0).
9. Indemnification
You agree to indemnify, defend, and hold harmless the Developer from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:
- Your violation of these Terms
- Your use of the App in a manner not authorized by these Terms
- Your violation of any applicable law or regulation
- Any unauthorized use, reproduction, or distribution of the App's content
10. Maintenance and Support
The Developer is solely responsible for providing any maintenance and support services for the App, as specified in these Terms or as required under applicable law.
Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.

11. Product Claims
The Developer, not Apple, is responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of the App, including but not limited to:
- Product liability claims
- Any claim that the App fails to conform to any applicable legal or regulatory requirement
- Claims arising under consumer protection, privacy, or similar legislation
12. Intellectual Property Claims
The Developer, not Apple, is solely responsible for the investigation, defense, settlement, and discharge of any intellectual property infringement claim related to the App.

13. Legal Compliance
You represent and warrant that:
- You are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country
- You are not listed on any U.S. Government list of prohibited or restricted parties
14. Third-Party Terms
When using the App, you must comply with any applicable third-party terms of agreement. For example, if the App is used over a wireless data connection, you must comply with the terms of your wireless data service agreement.
The App uses the following third-party services, each subject to their own terms:

15. Third-Party Beneficiary
You acknowledge and agree that Apple and its subsidiaries are third-party beneficiaries of these Terms of Use. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.
16. Privacy
Your privacy is important to us. Our collection and use of information is governed by our Privacy Policy, which is incorporated into these Terms by reference.
In summary: we do not collect any personally identifiable information. All data stored by the App (favorites, progress, session history) remains on your device and is never transmitted to our servers.
17. Termination
These Terms are effective until terminated by you or by us. Your rights under these Terms will terminate automatically if you fail to comply with any of its terms, including but not limited to the intellectual property restrictions set forth in Section 4.
Upon termination:
- You must cease all use of the App
- You must delete all copies of the App from your devices
- You must cease any use of the App's content, including content previously accessed, saved, or extracted
- All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnification, and limitations of liability
We may also terminate or suspend your access to premium features if we detect fraudulent activity, abuse, or unauthorized use of the App's content.
18. Changes to These Terms
We may update these Terms from time to time. When we do, we will update the "Last Updated" date and version number at the top of this page.
For material changes, we will make reasonable efforts to notify you within the App at least thirty (30) days before the changes take effect. If you do not agree with the revised Terms, you must stop using the App before the changes take effect. Your continued use of the App after the thirty (30) day notice period constitutes acceptance of the updated Terms.
19. Dispute Resolution
Before initiating any formal legal proceedings, you agree to first contact us at info@getsaymore.app with a description of your concern. We will make reasonable efforts to resolve the matter informally within thirty (30) days of receiving your notice.
If the dispute is not resolved within this period, either party may proceed with formal legal action in accordance with the Governing Law section below.
20. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Portugal, without regard to conflict of law provisions.
Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Portugal, unless mandatory consumer protection laws in your jurisdiction provide otherwise.
21. Severability
If any provision of these Terms is held to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect.
